Key Professional Accomplishments

Danny Kach’s practice is concentrated on energy, commercial real estate, construction, general counsel, technology and general business related issues.  Having begun his career at a boutique commercial real estate law firm, Mr. Kach is well versed in commercial real estate transactions such as real property purchase and sale agreements, financings, 1031 exchanges, and commercial retail and office leasing.

Mr. Kach then spent 6 years as assistant general counsel of Invenergy LLC, the largest independent power producer in the US, whose business model is building, owning and operating alternative energy facilities, such as wind, solar, thermal and energy storage facilities.  During his tenure as assistant general counsel, Mr. Kach managed the company’s legal needs for real estate and construction, successfully facilitating the completion of 25 projects across 12 states and Canadian provinces totaling more than $4 billion in financing and project sale transactions.  Such work included over $500 million in negotiated construction contracts.  Mr. Kach also completed a number of pre-construction project purchases and sales and post-construction re-financing due diligence.  In addition, Mr. Kach has extensive experience negotiating equipment, engineering, operating, software, consulting, services, confidentiality and other related agreements, with representative matters described below.

Representative Projects and Engagements

  • Successfully managed all real estate due diligence for financing or sale of 19 wind facilities totaling more than $3 billion
  • Successfully managed all real estate due diligence for financing of 4 solar facilities totaling more than $100 million
  • Successfully managed all real estate due diligence for either financing or refinancing of 5 thermal facilities totaling more than $1 billion
  • Successfully managed all real estate due diligence needs for 2 energy storage facilities totaling more than $15 million
  • Successfully negotiated membership interest purchase agreement for $20 million energy storage facility
  • Successfully negotiated asset purchase agreement for two $100 million solar developments
  • Represented multiple developers in completing land purchases, financing construction and sales transactions
  • Represented multiple real estate investors in vacant and occupied real property purchases and sales transactions

Mr. Kach received his Juris Doctor degree in 2005, from Washington University School of Law in St. Louis, and Bachelor of Arts degrees in Economics and Spanish in 2002 from the University of Michigan.  Mr. Kach is proficient in Spanish.
